If you still have questions after reading this contact us using the online form.
What is Service of Process?
The term "process" denotes a summons or order made by a court, including a document issued or made by a court for service on parties (such as a defendant to claim). “Service” of process is the formal delivery of such documents, so as to enable that person to respond to the proceedings before the court.
How is Process served?
A set of court documents is delivered to the person named on said documents, or to their appointed Process Agent in the jurisdiction of the court.
What is a process agent and why do I need one?
A Process Agent is a representative upon whom court papers may be served. There are special rules for serving process outside of England and Wales and it is often simpler to appoint a Process Agent within the jurisdiction.
What services do you provide as Process Agent?
The Process Agent provides a registered address within the United Kingdom through which legal documents issued by the courts can be served on involved parties based overseas. It is our role as Process Agent to sign for any documents received in relation to an appointment and forward them for delivery to the addressees stipulated in the Service of Process appointment letter.
What is the entity we are appointing, and that will be acting, as our UK Process Agent?
The entity that will act as UK Process Agent will be Apex Agency Services Ltd (registered in England, company No. 5322656), with its registered address being 140 London Wall, London, EC2Y 5DN.
What details will be required to complete the appointment process?
To appoint us as UK Process Agent, in addition to entering your contact details, you will be required to enter:
- The full name, address and contact details (email and telephone number) of the entity for whom we are to act as Process Agent (the Appointing Entity/Appointor).
- The name/title of the document(s) we are to be appointed as UK Process Agent under.
- The parties in relation to the document(s).
- The duration for which you wish to appoint us.
- Additionally, if the Appointor is a company resident in an EU member country and is registered for VAT, we will also require the company’s valid VAT registration number.
What are your fees for acting as Process Agent?
Our fees can be calculated on this site via the online fee calculator and are dependent upon the duration of the appointment and the number of documents for which we are appointed as Process Agent for. After the initial fee, no further annual renewal fees are payable unless you wish to extend the appointment beyond its initial term.
If documents are served and delivery of original paper documents is then requested, additional delivery charges can only be calculated at the time of delivery.
Will I be required to pay any further fees in relation to the appointment?
There are no other fees payable unless you wish to extend your appointment.
If you wish to extend your appointment past its original term, there will be a fee payable of £100 per additional year.
If documents are served and physical delivery of documents is requested, additional delivery costs may be payable.
Will I receive an invoice in relation to the fee?
An invoice will be produced online at the end of the appointment process which you can download in pdf. format via your online account.
The online form only refers to an Appointor being a company. Do you accept appointments for private individuals?
No, this service is only available for corporate or business purposes.
I am making an appointment on behalf of a client with whom I may not have further contact after the current deal that I am working on with them finishes. Will I need to be involved in maintaining the appointment after it has been made?
Creating an account on our online system will enable us to send you a Final Confirmation email once the appointment is complete. The contact details provided in the ‘Appointor’s Details’ section will be used for any subsequent notices or correspondence.
Do you need to see the documents for which you are appointed as Process Agent?
No, we do not require a copy of the documents.
Do you require the Appointment Letter to be countersigned and returned to you?
No, we do not require this although we are happy to receive countersigned Appointment Letters should you wish to return them to us.
What are the accepted payment methods?
The online application process allows users to choose to pay by either bank transfer or credit card (WorldPay).
Before I complete the online order process, can I have a fee quote?
We have an online fee calculator that allows you to calculate the fee for your order by stating the number of documents you have and the number of years you would like to appoint us for.
Will I be charged VAT?
If the Appointor is a company resident in an EU member country and provides a registered VAT number, then VAT will not be charged. If the Appointor is a resident in an EU member country and do not provide a valid VAT registration number, then VAT will be applied to the appointment fee payable.
International Appointors outside of the EU will not be charged VAT.
